### Copyright Winter Is Coming (To Wikipedia?)

The phrase “Winter is Coming” evokes a sense of impending dread, a long, hard season that will test the resilience of all who face it. For years, Wikipedia has been a seemingly unshakable pillar of the free and open internet—a collaborative, non-profit beacon of knowledge. But on the horizon, the storm clouds of copyright law are gathering, and a chilling wind is beginning to blow. Is a copyright winter coming for the world’s largest encyclopedia?

Wikipedia’s entire ecosystem is built on a delicate balance of copyright principles. The vast majority of its text is licensed under the Creative Commons Attribution-ShareAlike (CC BY-SA) license, which allows anyone to freely use, share, and build upon the work, as long as they give credit and share their new creations under the same terms. Its images and media are a mix of Creative Commons licenses, public domain works, and a carefully curated selection of copyrighted material used under the doctrine of “fair use.” This foundation allows knowledge to be shared and remixed globally, but it’s a foundation that is becoming increasingly fragile.

The first major threat comes from a global trend towards more restrictive copyright legislation. The most prominent example is the European Union’s Directive on Copyright in the Digital Single Market. Its controversial Article 17 (formerly Article 13) places greater liability on online platforms for copyrighted content uploaded by their users. While non-commercial projects like Wikipedia were granted an exemption, the directive signals a significant shift in the internet’s legal landscape. It pushes the web towards a model of “upload filters”—automated systems that proactively scan and block content before it’s even published. This creates a chilling effect, where platforms may over-censor legitimate content, including fair use, to avoid the risk of massive fines. As the internet becomes more filtered, the pool of freely accessible sources and media that Wikipedia volunteers rely on begins to shrink.

Adding a new, unpredictable blizzard to the forecast is the rise of generative artificial intelligence. Ironically, many of the large language models (LLMs) that now dominate the tech world were trained on the vast corpus of text from Wikipedia itself. Now, this relationship is becoming complicated. As copyright holders move to protect their content from being scraped for AI training, the open web that Wikipedia uses for sourcing and verification is being locked behind paywalls and restrictive terms of service. Furthermore, the legal status of AI-generated content is a minefield. Can an AI-generated image be uploaded to Wikimedia Commons? Who is the author? Does it even have a copyright? These are thorny questions that Wikipedia’s community-driven model is now forced to confront.

Finally, the very concept of “fair use” is under constant pressure. Fair use is not a universal right but a legal defense, one that often requires a costly court battle to prove. For a volunteer-driven project, facing down a multi-billion dollar media corporation over the use of a single image or a short clip is a daunting prospect. As copyright holders become more aggressive with automated takedown notices, the risk of including crucial, context-providing media—like a movie poster on a film’s page or a corporate logo on a company’s page—grows. Each successful challenge chips away at the encyclopedia’s ability to be a comprehensive and visually rich resource.

Wikipedia has weathered storms before, from internal edit wars to external misinformation campaigns. But this is different. This is a systemic, legal, and technological shift that threatens the core principles of sharing and collaboration that brought it into existence. The “winter” that may be coming isn’t one of snow and ice, but one of permissions, paywalls, and automated censorship. The question is no longer whether the storm will hit, but whether the global community that built and sustains this incredible repository of human knowledge has the strength to endure the long night ahead.
